Co-operating with the regulatory authorities

If an immunity or leniency application is made, this is likely to carry with it duties of on-going co-operation. See here for more information.

In some jurisdictions fines may be discounted if an undertaking co-operates with the regulator’s investigation.

Even where no immunity or leniency application is made, there can be significant penalties for failing to co-operate with regulatory investigations, particularly in the context of dawn raids. For example, breaching a seal that has been fixed by inspectors during the course of a dawn raid may carry separate (and severe) penalties. See information on dawn raids.
